This Website is offered and available to users who are 18 years of age or older and reside in the United States or any of its territories or possessions. Marketing Communication
TaxRise uses SMS to communicate with users who have expressed interest in our services via our online forms.
- When you opt-in to the service, we will send you an SMS message to confirm your signup.
- You may receive notifications about updates made to your case or messages for marketing purposes.
- You can cancel the SMS service at any time. Just text “STOP” to the shortcode. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- If at any time you forget what keywords are supported, just text “HELP” to the shortcode. After you send the SMS message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
- We can deliver messages to the following mobile phone carriers: Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile. Intellectual Property Rights
The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Indemnification
You agree to defend, indemnify and hold harmless the Company, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Website, including, but not limited to, any Content you provide, any use of the Website’s content, services and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the Website.
Governing Law and Jurisdiction
All matters relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction).
Dispute Resolution
YOU AND THE COMPANY AGREE TO THE FOLLOWING MANDATORY ARBITRATION AND CLASS ACTION WAIVER PROVISIONS:
MANDATORY ARBITRATION. You and the Company agree to resolve any claims arising out of or relating to the Website or these Terms of Use, regardless of when the claim arose, even if it was before these Terms of Use existed (a “Dispute”), through final and binding arbitration.
Informal Dispute Resolution. We would like to understand and try to address the your concerns as quickly and easily as possible before formal legal action. Before the we or you file a claim against the other, we both agree to try to resolve our Dispute informally. You agree to do so by sending us a notice to legal@taxrise.com. We will do so by sending you a notice to the email address you provided to us. If we are unable to resolve the Dispute within 60 days, either of us has the right to initiate arbitration. We also both agree to attend an individual settlement conference if either party requests one during this time. Any statute of limitations will be tolled during this informal resolution process.
Mandatory Arbitration. Arbitration means an impartial third party will hear the Dispute between you and us and provide a decision. Binding arbitration means the decision of the arbitrator is final and enforceable. The arbitrator shall decide any Dispute under these arbitration terms. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
Arbitration Forum. These arbitration terms are governed by the Federal Arbitration Act notwithstanding the provisions of these Terms of Use specifying the application of California state law. JAMS will administer each arbitration and the arbitration shall be conducted by a single arbitrator. If JAMS is unavailable or unwilling to administer the arbitration consistent with these arbitration terms, the parties shall agree to, or the court shall select, another arbitration provider. The arbitrator will be either a retired judge or an attorney licensed to practice law. The selection of the arbitrator will be according to JAMS Comprehensive Arbitration Rules & Procedures which can be found at www.jamsadr.com and are incorporated by reference into this clause. The arbitrator shall be neutral and independent and shall comply with JAMS Code of Ethics. The arbitration shall be held in your state of residence and conducted by videoconference. If the arbitrator determines a hearing should be conducted in person, the location shall be mutually agreed upon, in the county where you reside, or as determined by the arbitrator.
Exceptions. This section does not require arbitration of the following claims: (i) individual claims brought in small claims court; and (ii) injunctive or other equitable relief to stop unauthorized use or abuse of the Website or intellectual property infringement or misappropriation.
CLASS AND JURY TRIAL WAIVERS. You and the Company agree that Disputes shall be brought on an individual basis only, and may not join or consolidate disputes by or against others as a representative or member of a class, to obtain relief in any arbitration in the interests of the general public, or to act as a private attorney general. Class arbitrations, class actions, and representative actions are prohibited. Only individual relief is available. If 25 or more claims are filed by the same or coordinated counsel, then the JAMS Mass Arbitration Procedures and Guidelines, which can be found at www.jamsadr.com and are incorporated by reference into this clause, shall apply. You and the Company knowingly and irrevocably waive any right to trial by jury in any action, proceeding, or counterclaim.
Severability. If any part of these arbitration terms is found to be illegal or unenforceable, the remainder will remain in effect, except that if a finding of partial illegality or unenforceability would allow class arbitration, class action, or representative action, this entire dispute resolution section will be unenforceable in its entirety.
Limitation on Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Waiver and Severability
No waiver of by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
